CDD Editorial – Open House Signs & Fiduciary Responsibility

       The latest issue I have with the CDD is the issue of “open house” signs that Realtors use to draw traffic from the main roads. The CDD board voted several years ago, NOT to allow them except one or two in private yards. The current board members even take it upon themselves to enforce it by taking the signs and disposing of them.

       At the last CDD board meeting the Chairman actually proposed the CDD have their own “open house” signs made and rent them to the Realtors for $200. If the Realtor returns the signs, they get their $200 back. I lose an average one sign per open house.

       This is another example of CDD policy that does the opposite of the  purpose of the CDD. If people don’t see the houses, they will not buy the house. The more people that see the house the more likely the house is to sell. Remember from a previous newsletter? “Anytime you restrict demand for a product, you restrict the price.” Less lookers = less buyers. Less buyers = less offers. Less offers = lower offers. Lower offers = Lower values.

       Furthermore, a CDD supervisor’s job does not include code enforcement. Therefore, a board member taking a sign is simple theft. How stupid can this get? That would be like the Mayor taking down a business’ sign because it did not meet code.

       If proven in civil court, his proposal and the “THEFT OF SIGNS” is “BREACH OF FICUCIARY RESPONSIBILITY.” In short, it means, “FAILURE TO ACT IN THE BEST INTEREST” of Coral Bay. To “act in the best interest of” is the primary duty of any board member.

       We need leadership that knows what their purpose is and can recognize anything contrary to that purpose. We will not get it with this board. It is indicative of this board’s weakness in leadership that they have chosen the

Chairman from amongst themselves. The CDD Chairman was happy with the status quo of increasing assessments, the incomplete $2 million wall (est), the closed down parks & pools, the burned out lights, and the missing lights at the entranceway.

       Should I go on? He voted against allowing me to voluntarily refurbish the playground saving Coral Bay more than $25,000.

       He is happy with the old CDD management company and they are still managing his HOA. He, his HOA, and  that board, where he is a director, are named and embroiled in a civil lawsuit filed against them in December 2004. Among other things, they are charged with libel, and breach of fiduciary responsibility. Further, he was never elected but was appointed by the board. Then the other four board members voted to make him Chairman of the board. That is weak, weak, weak. :-(

       I have made my point. If any one of you want to run for a seat on our CDD board, call me. The election is November 2008 and there are deadlines to meet. I will help. n

Selling Houses By The Yard

         NEW YORK – Aug. 20, 2007 – Most homeowners know that replacing the roof or upgrading siding can enhance a house’s curb appeal and boost its sales price. Now, as the housing market continues to weaken, some people are considering what the payback will be if they invest in things that appraisers routinely overlook: flowers, shrubs and trees.

         Real-estate agents say a nicely landscaped property can have a pronounced effect on the asking price of a home, depending on the region and the condition of the neighbors’ yards. Doreen Drew recently sold a house in Anthem, Ariz., that had sculpted hedges, a lush lawn and a backyard waterfall for $1.1 million, nearly twice the asking price of a similar home nearby with a plainer yard. Bill Good, a broker in Colorado Springs, Colo., says he just sold a house with newly planted mature bushes and fresh sod in the front yard for $1.225 million; previously it had languished on the market for more than a year at $1.175 million. In Palm Beach County, Fla., homes with colorful flowers and tall palms typically sell for 10 percent to 15 percent more than those without these features, according to agent Nancy Macaluso. That’s why she’ll often lug huge potted plants to the homes of clients whose greenery needs a boost. “It makes a difference,” she says.  Read the rest of the article:

         It all started back in April when Eddie volunteered to do maintenance on the Coral Bay Play Ground. Eddie brought the CDD board reports each month for 3 months on the progress of the playground. In stages, the structure was bleached and water sealed. Bolts were replaced, and tightened. Seats and brackets were replaced and slides repaired. After the third report, the CDD board hired a structural engineer to certify the structure safe and he did. At the same meeting, the board approved building a new suspension bridge. The old one rotted and timbers had been  removed leaving gaps.

         Now that the structure was deemed safe and the playground open, Eddie decided to solicit the help of Pack 836 where he is Chairman of the Pack Committee. Prior to this, the only help Eddie got was from friend Greg Vankekerix, owner of Allied Metals, a roofing company, and Coral Bay Homeowner.

         On August 12, 2007, 24 Scouts & family members converged on the playground. They built the new bridge in about 2.5 hours. They also made repairs and trimmed back the grass from the mulch pit.

         Thank you to all who helped. The members of Pack 836 are terrific and I am proud to be associated with them.

         The total cost of the playground refurbishment excluding the engineer: Less than $500. That sure beats the estimated $30,000 cost of a new one.

         The National Association of Realtor’s just released research of what ALL home buyers want for “neighborhood features” in 2007 ranked “near park or playground” at #3 with 64% saying it is “important”. Near a playground beat out everything except, “near schools” and “near shopping.” n

· A CS more than a year old can not be used as a comparable (comp) property by an appraiser.

· The average original list price was $341,778.

· The average sale price was $313, 528.

· The average difference in asking & sale price is $27,406.

· That difference in percentage is 8% less than original.

· 82.5% REDUCED their price before the property sold.

· The REDUCED average list price was $324,647.

· The sale price was 3.36% less than the reduced list price.

· Many 0ther Realtors leave the square feet of Land blank if they think it may hinder sale of the property.

· The average Total Square Feet was 1711 SF.

In A Sellers Mind

         One of the most delicate things that a Realtor has to do is discuss price, terms, and condition of the home with their listing  clients. The Realtor does a walk through, makes a list of recommendations, and presents the list to the seller. Sometimes, the walkthrough is done after the seller has done all they know or want to do as agreed to.

         There are many reasons a seller might resist these recommendations. Sometimes, the seller’s feelings are hurt, or they are insulted, or they believe they know what’s best. Often, the seller has an emotional attachment to the house that they may or may not be aware of. Or they have already invested a lot of personal time, effort, and money to fix the house up to sell.

         When a client has put a lot of time and effort into their home, and the Realtor makes additional recommendations, they become resistant. A Realtor is not insulting their tastes, but rather knows what will appeal to the greatest number of people and wants to do exactly that. I spend about an hour each day studying market conditions, trends and statistics, including what buyers are looking for. When selling a house, it is time to put aside your own tastes and try to appeal to the maximum number of people as possible. A Realtor will make recommendations that appeal to the 80% of buyers tastes. The seller sometimes insists on keeping the condition that appeals to the 20% of buyers (i.e., a brightly colored room).

         Further, a good Realtor will not recommend improvements that will not pay you back. Sometimes, the suggestions take only time, or a costs a few dollars and a few hours. (i.e. caulking). We study which improvements are likely to pay you back. Put another way, you will probably get your money back and then some when you sell.

         Trust your Realtor, that’s why you hired them. If you don’t, it could cost you. n

EXPIRED LISTINGS

· Expired listings are not calculated in “Days on Market” (DOM) statistics. (the stat is useless)

· An Expired listing is one that did not sell during the duration of the listing contract

· A listing contract is usually 3 or 6 months, depending on market conditions.

· There were more Expired listings (65) in Coral Bay in the last 12 months than “closed sales.”

FIRST IMPRESSIONS

         Studies show that 50% of home purchase decisions are made during the first 60 seconds. You can spend thousands of dollars on remodeling the  inside of your home for resale, but if it doesn’t grab the buyer’s attention from the curb, many potential buyers will drive right by.

         To determine what needs to be done to create a good first impression, walk across the street and study your house with fresh eyes. Or, enlist the help of a real estate professional who can give you expert advice on preparing your home.

         Start by cleaning up any debris. Repair loose roof shingles and fill cracks in the walkway. Remove grease or oil spots on the driveway. Repair torn screens. Clean outdoor light fixtures. Prune trees and shrubs. Make sure the front steps are clean and attractive.

         Don’t forget the mailbox, which may be the first feature the buyers will see as they look for your home’s address. If it’s weather-beaten or dented, replace it. Add visual interest by positioning rocks and potted plants around it.

         Next give your home exterior a face lift with a power wash or paint job. Be sure to use a conservative color palette that would appeal to most people. If you budget or schedule does not allow for painting the entire exterior, just painting the trim can make a big difference (check with your HOA first).

         Continue the appeal with a friendly front door. Restore its luster with a coat of varnish or a rich, new accent color. Make sure the doorbell works properly.

         Enhance your landscape with foliage or splashes of  color. It could be as simple as adding a flower bed, planting shrubs near your entryway, or filling a couple a couple of large pots with bright flowers and  ornamental grasses. When landscaping for resale, play it safe by reflecting the style of nearby homes. (Source: Century 21 client literature for sale to agents).  n

 CDD FACTS

· CDD Board Members are paid  $200 for each meeting they attend.

· But, the limit is $4800 per year per board member.

· The rate of pay is set by Florida statute 190 that allows the CDD to exist.

· The CDD board is subject to the FL State Sunshine laws that limits what they can do outside of meetings.

· This is far stricter than our HOA boards that are private corporations.

· The board has direct authority to tax you but the law calls it an assessment.

· Every home in Coral Bay pays the exact same assessment.

· The assessment is the budget divided by the number of homes (997).

· The board manages all things that our eight HOAs share in common.

· The 5 member publicly elected “Supervisors” choose the “Chair” & “Vice Chair” amongst themselves.

· There are about 25 Community Dev. Districts (CDDs) in Broward

· There are about 84 Special Taxing Districts in Broward (i.e. water, hosp,)
